[July 29, 2009]  ELLENSBURG, Wash. (AP) -- A Washington state man accused of holding up a convenience store with his 9-year-old daughter at his side teared up when surveillance video from the store was shown in court.

Charges against 42-year-old Robert Daniel Webb of Everett include first-degree robbery. His trial began Tuesday in Kittitas County Superior Court.

Video of the March 31 holdup showed the robber telling the clerk he needed money for his daughter. He got away with about $200.

The Daily Record reports that four witnesses testified Tuesday, including the store clerk, Eric Owens. The clerk told the court that he was uncertain whether the robber's gun was real or a toy.

The gun was later determined to be a toy that had been painted black.

The trial continues Wednesday.
