Investigation of N.Y. Wal-Mart trampling death ends

[May 06, 2009]  MINEOLA, N.Y. (AP) -- A New York prosecutor is ending a criminal investigation into the post-Thanksgiving trampling death of a temporary employee at a Long Island Wal-Mart.

Nassau County District Attorney Kathleen Rice's office says the prosecutor and a Wal-Mart vice president will announce an agreement Wednesday that calls for the company to improve safety measures and provide funding for victims.

No criminal charges are expected.

Jdimytai (jim-mee-TREE') Damour (Di-MOHR'), a temporary worker at Wal-Mart's Valley Stream store, was trampled to death by hundreds of bargain-hunters who entered the store on Black Friday 2008. Four others were injured.

Police said afterward that retailers are responsible for crowd control when holding large promotional sales.
