It has been counting on the popularity of the brand as part of its efforts to help revitalize its business under new CEO Ron Johnson. A representative for J.C. Penney, which is based in Plano, Texas, said the company does not comment on pending litigation. Macy's shares ended regular trading up 20 cents at $38.74 on Thursday. The stock added 2 cents to $38.76 in aftermarket trading. Shares of J.C. Penney slipped 8 cents to $24.23 in extended trading after rising 64 cents, or 2.7 percent, to $24.31 during the regular session. New York-based Martha Stewart Living Omnimedia Inc. finished regular trading up 4 cents at $3.12. They were unchanged afterhours.
