Fireworks: What is allowed and what is illegal for the consumer?

Topic: Fireworks

Question: Fireworks, what is allowed and what is illegal for the consumer?

Answer: Fireworks are placed in two categories: 1 Consumer fireworks and 2 Display Fireworks.

Consumer fireworks: All consumer fireworks distributers shall have a permit from the State Fire Marshal’s Office and have a proof of registration on hand at all times. A $50 dollar fee to the Office of the State Fire Marshal is required to sell consumer fireworks.

Consumer fireworks legal in the State of Illinois and in the City of Lincoln consist of the following: Unregulated novelty fireworks such as snakes, glow worms, smoke devices, trick noise makers: party poppers, booby traps, snappers, trick matches, cigarette loads and auto burglar alarms. Sparklers, toy pistols, toy canes, toy guns, or other devices in which paper or plastic caps containing .25 grains or less of exploding compound are used, provided they are constructed so that the hand cannot come in contact with the cap when exploded. These are considered novelty fireworks and sale and use is permitted at all times.

Approved consumer fireworks must comply with the consumer product safety commission and be labeled as 1.4G consumer or 1.4S UN0337 outdoor consumer use fireworks. These fireworks must be ground mounted No hand held fireworks and are limited to the following: Cones including showers of sparks, fountains and repeaters (Cakes). Mines, comets, tubes, shells, fancy floral and parachutes are designed to have low level aerial effects as long as they do not exceed 40 grams of charge and 20 grams of lift charge.

Illegal fireworks consist of: hand held fireworks, bottle rockets, firecrackers, sky rockets, roman candles, Chasers, buzz bombs, helicopters, missiles pin wheels and planes.

Display fireworks are only allowed by professional and licensed users.
