On April 30, 2013, Judge William Yoder accepted a fully negotiated
plea sending Kyle Welch, of the 400 block of South Chicago Street,
Lincoln, Illinois, back to the Department of Corrections for a total
of 10 years followed by 2 years of Mandatory Supervised Release,
formally called parole.
Welch will serve 3
years, the maximum sentence, for committing the offense of Criminal
Damage to Property. On October 8, 2011, Welch was inside the OK
Tavern when he got into a verbal argument with another patron. The
argument continued outside the bar and the other patron entered a
vehicle. Welch then threw a pot, which was being used as an ashtray,
onto the hood of the vehicle causing over $600.00 of damage to the
vehicle.
Welch will serve 7
years for committing the offense of Unlawful Possession of
Controlled Substance. On February 23, 2013, Welch was inside the
Wishbone Bar when he got into a verbal argument with another patron.
Lincoln Police units were dispatched to the bar and Welch was
subsequently arrested for Resisting a Peace Officer. After Welch was
arrested, officers searched Welch and found over 24 grams of cocaine
in his pants pocket. Welch faced 4 to 15 years in the Department of
Correction for this offense.

Welch must serve the sentences
consecutive because Welch committed the February 23, 2013 offense
while he was released on bond for the October 8, 2011 offense. Welch
has previously been to the Department of Corrections for 5 years for
committing the offense of Unlawful Possession of Controlled
Substance. Welch has also been convicted of felony
Fleeing/Attempting to Elude (2004), and misdemeanor offenses of
Criminal Trespass to Vehicle (2003); DUI (2004); and Disorderly
Conduct (2009). Welch must serve 50% of the time and was given
credit for 69 days that he was in Logan County jail.
