They also say he and his older brother, Tamerlan Tsarnaev,
killed a university police officer three days later as they
attempted to flee the city. Tamerlan died later that night after
a gunfight with police.The surviving Tsarnaev brother faces the
possibility of execution if he is convicted.In a court filing on
Thursday, U.S. Attorney Carmen Ortiz noted several pending
motions in the case, including requests by Tsarnaev's lawyers to
suppress physical and electronically stored evidence and the
government's opposition. Defense attorneys earlier this month
asked the court to order the government to provide full
documents purportedly from the Russian government that outline
Tamerlan Tsarnaev's "pre-existing intention to engage in violent
jihad," according to court documents.Last month, U.S. District
Judge George O'Toole denied a bid by Tsarnaev to move his trial
out of Boston, but agreed to delay the start of the trial by two
months to January, pushing it back after the U.S. holiday
season.
