On
December 13, 2016, Associate Judge William Workman accepted a fully
negotiated plea agreement sentencing Brian Callahan to a total of 20
years in prison.

Specifically, Callahan pleaded guilty to one count of Predatory Criminal
Sexual Assault of a Child, a class X felony, for 10 years in prison and
a separate count of Predatory Criminal Sexual Assault of a Child, a
class X felony, for 10 years in prison. The two sentences will run
consecutive to the other for a total of 20 years. Each sentence carries
a period of mandatory supervised release (formerly known as parole) from
3 years to natural life. The Prison Review Board will set the specific
amount of supervised release. In addition, Callahan is required to serve
at least 85% of the 20 year sentence before he becomes eligible for
consideration for supervised release.
The conviction and sentence stem from a Lincoln Police Department
investigation based upon a mandated report through the Department of
Children and Family Services hotline. The minor victim and her siblings
were forensically interviewed at a Child Advocacy Center. The interview
of the victim and the victim’s brother disclosed sexual penetration by
Callahan upon the victim, who was 5 years old at the time of the
offense.

“This sentence achieves a significant period of incarceration for
the protection of the victim and the public without having to put
the victim through the trauma of testimony at trial,” stated
Jonathan Wright, Logan County State’s Attorney.
