Those who pass stopped school buses risk loss of driving privileges

We have recently had a number of vehicles passing school buses while the buses are loading or unloading students. This is notice to the public that anyone who passes a school bus while it's Stop Arm and Lights are activated is in violation of the Illinois Vehicle Code section 625 ILCS 5/11-1414a.

Per this section, the driver of a vehicle shall not proceed past a loading or unloading school bus unless the driver of a vehicle is signaled by the school bus driver to proceed or the visual signals are no longer actuated. The bus drivers are "policing" the areas where children are loading or unloading and will readily report any violators of this section.

This is fair warning that a citation for this violation will be issued if the driver of a school bus can provide an accurate description of the passing vehicle I.E. make, model, and color with a complete license plate number and/or positive identification of the driver of the passing vehicle. A citation for violation of this section requires a mandated court appearance that will likely result in a suspension of driving privileges, fines and court fees.

What if the vehicle passing the school bus has been "borrowed" and the registered owner of the vehicle was not the driver when a vehicle passes a loading or unloading school bus.

In this circumstance, the owner of the vehicle will be required upon request of the State's Attorney or other designated person acting in response to a signed complaint, to provide documentation identifying the operator of the vehicle at the time of the alleged violation. Per Statute, failure to comply with providing this information can result in a suspension of the vehicle registration for a period of three months.
