54 death cases in limbo

Illinois Supreme Court gives lawyers 30 days to file motions

[JAN. 25, 2003]  The Supreme Court of Illinois issued an order Wednesday covering 54 death-penalty cases that were pending before the court when former Gov. George Ryan commuted death sentences.

The order said lawyers on both sides of each case have 30 days to file any motions they deem appropriate in the wake of Mr. Ryan's commutations. The motions may include, but are not limited to, whether the Supreme Court would have continued jurisdiction in the matters.

Under the Illinois Constitution, cases in which the death penalty is imposed are appealed directly from the Circuit Court to the Supreme Court as a matter of right. Typically, the appeals also concern issues other than sentence.

The orders issued in the individual cases Wednesday are similar to an order the court issued Jan. 14 in the death-penalty case of Gabriel Solache. Oral argument in the case was scheduled that morning before the Supreme Court. After meeting in conference, however, the court issued an order from the bench giving attorneys in both sides of the case 30 days from that day to file whatever motions they deem appropriate in light of former Gov. Ryan's commutations.

The 54 cases before the court include the Solace case. They include 14 cases which had been argued and are under advisement by the court, six cases on the re-hearing docket, 28 cases which were in various stages of being briefed by the lawyers in advance of oral argument and six other cases in which briefing has been stayed for various reasons.

Collectible medallions honoring Lincoln, Grant, Reagan, Stevenson and Washington available

[JAN. 25, 2003]  SPRINGFIELD -- Five of Illinois’ finest public figures are being honored with collectible medallions now available through Illinois State Treasurer Judy Baar Topinka’s office.

The medallions -- authorized by the Illinois General Assembly in 2000 -- feature the honored individuals’ likeness on one side, with the Great Seal of the State of Illinois on the reverse side. Those being honored are U.S. Presidents Abraham Lincoln, Ulysses S. Grant and Ronald Reagan; the late Illinois Gov. Adlai E. Stevenson; and the late Harold Washington, mayor of Chicago.

Topinka said the medallions were created to honor selected historic citizens of the state.

"Illinois has so many outstanding citizens that have helped shape this state and country’s history; we’re glad to have the opportunity to honor their achievements," said Topinka. "Whether it was leading our nation through some of its most trying times or breaking through barriers, these men left their mark on Illinois and the nation."

Through a cooperative effort with the Northwest Territorial Mint, the medallions are offered in three different metals. In a gold select finish, the proof costs $55; the silver proof costs $35; and the brass costs $10. The Presidential Set contains the Lincoln, Grant and Reagan medallions in the gold finish for $165. A limited edition The Honored Citizens Set containing all five medallions will be available for $250. Each medallion comes with a certificate of authenticity and a protective case.

A portion of the profits from the sale of the medallions will be used to benefit the causes championed by the individuals honored on the medallions.
